A few days ago I received a check from the Philips Settlement Administrator for $479.50 .  This was more than I expected, so I wonder if that had to do with my using a more expensive machine, a DS1 BiPAP autoASV.  

Jan. 2023 I received a replacement autoASV at my local AEROCARE store in Memphis TN at no charge. My old ASV was labelled DSX900T11C, 2020-02-06 REV00.  The new machine is labelled DXS900S11F, 2022-09-09 REV15. At the AEROCARE store I gave up my old autoASV which I had defoamed.

Device Chief’s Potential Conflicts

Note: Dr. Jeffrey E. Shuren was the head of the FDA's response to the Philips Recall. He was mentioned numerous times on this Thread.

A top medical device regulator’s work sometimes overlapped with his wife’s legal representation of clients with business before the agency.

Two members of Congress have asked an inspector general to investigate whether the top federal regulator for medical devices like pacemakers and artificial hips acted ethically in work that overlapped with that of his wife, a leading lawyer for device companies.

The lawmakers cited an investigation by The New York Times that examined the intersection of the work of the regulator, Dr. Jeffrey Shuren of the Food and Drug Administration, and his wife, Allison Shuren, a co-chair of the drug and medical device practice at the prominent Washington office of Arnold & Porter.

Comment: I thought I would find no more news stories to post. This bad dream for everyone still seems to have a life.

Has anyone received a visa gift card yet . When applying for the reimbursements I recall the paperwork indicating that the gift card was the preferred payment method that would be the fastest payment.
Also has anyone received money towards them purchasing a replacement device?

We received our "settlement" on our full-sized units.
Crickets on our DS Go units, other than the buyouts.
Long ago, we gave up on Philips doing the right thing.
They're only doing what's required thru judicial force.

On a side note, we love our ResMed AS 11 units.

I haven’t even heard crickets. I’m going to see if there’s any way to check on status. I have my confirmation number, maybe I can find something out that way.

I don't have any updates on payments but...

I received my replacement Dreamstation Go yesterday. This was 1,236 days after I registered it in the recall...so about 3 1/2 years.

It is a new unit with a date of 2024-09-26, and has 0 hours on the machine and blower.

It came as just the unit itself, no covers, no power cord, and included only the filter.

I am not planning on sending the old machine back since I'm hanging onto my recalled machines as-is.

I sent an email a couple minutes ago asking about the status of my claims. I just got an auto-response saying to expect 3-5 days to hear back from them.

Payments for eligible claims began earlier this summer and will continue on a rolling basis. We are unable to provide a date for individual payments.

Device Replacement Awards and Payer Awards will not begin to be distributed until after all claims submitted by the August 9, 2024 deadline have been fully processed. We do not have an estimate on how long this will take. Please be patient.
